Cannabis Retail Registration

Applicants with preliminary license approval from the State of Minnesota can apply for retail registration with the City of Roseville. Applications are processed on a first come first serve basis and are not considered complete until application materials and payment have been submitted. Payment can be made in person at city hall or mailed to:

In 2023, the State of Minnesota decriminalized the possession and use of cannabis, which includes marijuana, for people 21 and older.

While the State of Minnesota's Office of Cannabis Management has been established to oversee the implementation and regulation of cannabis, cities will play a limited role in regulating these businesses in their communities.

Under state law, cannabis business licenses may begin to be issued on January 1, 2025, and any locally enacted moratoria will expire.

The City of Roseville City Council has approved three new local ordinances regulating the registration and location of cannabis businesses and events in the city.

The Council passed the following ordinances at the November 25, 2024 meeting:

  • Zoning Ordinance that regulates the location of cannabis businesses in the city including cultivation, manufacturer, wholesaler, and retail operations. 
  • Business Registration Ordinance that requires annual registration of cannabis retail businesses following background and compliance checks. The ordinance limits the number of cannabis retailers in the city to three. The ordinance also sets hours of operation between 8 a.m. and 10 p.m. Monday through Saturday, and 10 a.m. to 9 p.m. on Sunday. 
  • Temporary Cannabis Events Ordinance that requires a city special events permit, security, and other conditions for events where cannabis will be present.

In the fall of 2024, city leaders established a timeline to complete this process, which included opportunities for public input and comment at both City Council and Planning Commission meetings.

The ordinances go into effect Jan. 1. 2025.

Relevant rights an individual has under the cannabis law

  • Possession limits:  flower – 2 oz. in public, 2 lbs. in private residence
  • Concentrate – 8g
  • Edibles – 800 mg THC
  • Consumption is allowed on private property
  • Gifting cannabis to another individual over 21 years old is allowed, subject to possession limits
  • Home cultivation is limited to four mature plants and four immature plants (8 total) grown at a single residence, including the curtilage or yard.

History of Cannabis in Minnesota

2014: The Minnesota Medical Marijuana Act is passed legalizing marijuana for the treatment of nine severe medical conditions, including cancer, severe epilepsy, and HIV/AIDS. 2022: Lower-potency hemp edibles and beverages containing tetrahydrocannabinol (THC) became legal in Minnesota.

2023: State of Minnesota decriminalized the possession and use of cannabis, which includes marijuana, for people 21 and older.

2024: State of Minnesota updated the adult-use cannabis law allowing certain cultivation licenses to be issued in July of 2024.

2025: Under state law, all cannabis business licenses will begin to be issued on January 1, 2025 and any locally enacted moratoria will expire.

Existing Roseville ordinances that regulate smoking and cannabis use and sales

1. The city requires a license to sell lower-potency edible and beverages and caps the number of those licenses at eight. The cap does not include businesses with liquor licenses that choose to also sell edibles.

2. Smoking of tobacco and marijuana is prohibited in a public place including all parks.

State laws that regulate the use of cannabis

It is illegal to use cannabis when operating a motor vehicle or operating heavy machinery and where smoking and vaping are prohibited under the Minnesota Clean Indoor Air Act.

Cannabis cannot be used or possessed in the following locations:

  • Public school or charter schools and school buses
  • State correctional facilities
  • In a location where the smoke, aerosol or vapor of a cannabis product could be inhaled by a minor
  • On federal property (such as courthouses, airports and national parks)
  • While on an employer's premises, or operating an employer's vehicle, machinery or equipment

OCM has the authority to assess a fine of $250 if there is clear evidence showing a person has violated the law.

Complaints should be filed directly to OCM using this form.

The tax on cannabis product sales is 10% (this is in addition to the standard state and local sales tax rates). Medical cannabis product sales are not taxed.

Marijuana remains illegal under federal law, where it is still classified as a controlled substance.
